Andrew is a current founding director of Botten Dnistriansky Kellis Lawyers. He was admitted to practice as a Barrister and Solicitor in South Australia in 1997. He was subsequently admitted as a Barrister and Solicitor of the High Court and Federal Court of Australia. Prior to forming Botten Dnistriansky Kellis Lawyers in 2007, Andrew worked for approximately 10 years with a leading Adelaide commercial law firm in its insurance division.

 

Since Andrew’s admission to legal practice, he has worked primarily in the area of insurance litigation and has represented and continues to represent multiple insurers (both publicly listed and governmental) and their claims managers. He has been involved in the defence of several prominent South Australia based class actions such as the Alba Gelati Salmonella action and the Garibaldi Metwurst Salmonella action.

 

Andrew has extensive experience and expertise in the following areas of insurance litigation:

 

• WorkCover personal injury recovery actions including significant serious injury claims such as quadriplegia/tetraplegia, brain damage and excessive burns as well as death/dependency claims.

• Defending public and product liability personal injury claims on behalf of insurers.

• Other subrogated recovery actions representing insurers in respect of property, motor, commercial, home and contents and marine insurance claims.

• First party claims advising insurers as to indemnity and often involving issues of intoxication, fraud and policy construction issues.

 

Andrew’s other areas of legal expertise include:
